  • We can evaluate whether a Liability Medicare Set Aside (LMSA) is necessary for your case and draft the MSA within the scope of the special needs trust.  We prepare for incapacity using Durable Powers of Attorney or assisting with conservatorship. 

  • If one defense counsel insists on settling, but other parties are not ready, or there are additional issues to evaluate, a Qualified Settlement Fund can effectuate settlement to one or more defendants and hold the funds until other parties are ready to move forward.  The QSF does not disrupt benefits for the plaintiff, allows for the allocation of settlement dollars among multiple parties, and can defer taxable compensation for the plaintiff’s attorneys to another tax year.
